Governor Jared Polis signs Colorado psychedelics bill
Proposition 122. [“People can grow it for their own use… there’s no criminal penalties if you grow it yourself for recreational…” said Governor Jared Polis.] [Subsequently] Senate Bill 23-290… passed… before the 2023 session ended… puts guidelines on Proposition 122, the landmark psychedelics ballot initiative passed by Colorado voters last November [2022]. Although the bill received plenty of attention during its run through the Colorado Legislature, Polis’s office didn’t make a major announcement when the governor signed SB 290 on Tuesday, May 24, 2023.
The ballot initiative [Prop 122]… legalized therapeutic psilocybin… decriminalized personal cultivation, use and sharing of psilocybin mushrooms… SB 290… introduced by Senate President Stephen Fenberg, created guardrails for unlicensed psychedelic facilitators, restrictions for personal mushroom… cultivation, and criminal penalties for the unlicensed sale or distribution of psychedelics… unless expressly limited, a person who for the purpose of personal use and without remuneration, possesses, consumes, shares, cultivates, or manufactures… does not violate state or local law, except that nothing permits a person to distribute… to a person for certain unlawful purposes… must be conducted on private property and in a private and enclosed space, and would be limited to a space of twelve feet by twelve feet unless a larger area is allowed by local governments… unlicensed facilitators will be able to operate and take donations to recoup the costs of their services and psilocybin mushrooms provided for them… the teacher, Travis Tyler Fluck, says the mushrooms are a gift… in most of these decriminalized places, it’s not a crime – or a very minor one – to grow mushrooms and give them away… in more than 20 cities, states and counties
