Recriminalizing drug possession [Two 2024 Oregon ballot initiatives submitted]
Chief Petitioners, Nate Sickler, Resident of Medford, Oregon, Jerrod Murray, Resident of Portland, Oregon, Juanita Swartwood, Resident of Portland, Oregon… [supporting that manufacturing (growing) more than 12 grams of psilocybin containing mushrooms (Class A Felony) will be punished more harshly than manufacturing methamphetamine (Class B Felony)]… Class A Felonies in Oregon… are punishable by up to 20 years in prison, a fine of as much as $375,000, or both. Examples include the following first-degree offenses: kidnapping, rape, arson, and assault. Class B Felonies in Oregon… [In Oregon, class B felonies are punishable by up to 10 years in prison, a fine of up to $250,000, or both. In Oregon, possession of child pornography, extortion, aggravated theft, and second-degree manslaughter are class B felonies.]
SECTION 4. ORS 475.752 is amended to read: 475.752. (1) Except as authorized by ORS 475.005 to 475.285 and 475.752 to 475.980, it is unlawful for any person to manufacture or deliver a controlled substance, ie, (B) twelve grams or more of a mixture or substance containing a detectable amount of psilocybin 21 or psilocin… any person who violates this subsection with respect to: (a) A controlled substance in Schedule I, is guilty of a Class A felony, except as otherwise provided in ORS 475.886 [unlawful manufacture of methamphetamine which would remain a Class B felony] and 475.890 [unlawful delivery of methamphetamine which would remain a Class B felony]. (2) Except as authorized in ORS 475.005 to 475.285 and 475.752 to 475.980, it is unlawful for any person to create or deliver a counterfeit substance. Any person who violates this subsection with respect to: (a) A counterfeit substance in Schedule I, is guilty of a Class A felony.
